Doris... Rajiv has written a recent article on the changes to trust laws for 2012. Go the the articles archive under "Trusts" and you'll find it there. In reality the biggest threats to estate preservation come from uncovered medical and assisted living costs. If Boomers and their parents have not designed an integrated plan that includes health, housing, finances, legal and family (5 "dots" that must be connected!)then, yes, they are vulnerable, especially in this economic climate.

We BB's really need help navigating the gov. infested waters of death taxes, probate, etc., so we can preserve our parent's estate for the younger generation some of whom have cancer and mental disabilities. Also, where do we stand with living trust in 2012? I understand the rules have changed. How do we keep abreast of the rules that could affect our family's survival.

Just a curiosity question.

The format of the following sentence seems out of sync: "and often involved the Trustee simply sending a check to each other beneficiaries."

The portion, "to each other beneficiaries" is confusing. Should that be "to each of the other beneficiaries" or "to all of the other" or "to each beneficiary"?

Beyond this "petty" detail, I appreciate your news letter AND the work you all do!!

Does this mean that when the first of a couple dies, and there is a trust with one half going to the spouse and the other half into a trust, that the entire contents of the will, may be revealed to the children who will inherit down the road? I would not be too happy with that.

I agree. It does not make sense. This is an example of how Medicare guidelines are changing which forces someone to spend all their assets for health care at the end of their lives, and then go into another government program (Medicaid - which includes state funds as well as federal funds) which puts the burden of financial responsibility on the states (state/local taxpayer instead of federal government/federal taxes. Please comment. Thanks.

Re above- it is not a PHYSICIAN decision to admit a patient or keep on obs status. It is strictly by MEDICARE guidelines that patients are admitted or obs. Generally, since the criteria are so complex and not something that most physicians are even aware of, it falls to the hospital via care coordination or social work system to reccommend inpt or obs care for any particular patient. When families complain to me about admit status I have to refer to medicare guidelines and rules and not to physician medical decision making.

The article is really informative and beneficial for the senior citizens who needs balanced retirement plans.By knowing certain information, they can make decision to have the best long-term care insurance plan for themselves. A long-term care insurance policy is the best way in which you have to pay in advance and that too in fewer amounts in order to combat future's big financial problems.
